§1 Applicability to entrepreneurs and definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (§ 13 BGB).
§2 Formation of a contract, storage of the contract text

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase agreement.

The order process consists of the following steps:

2) Confirm by clicking the "Add to Cart" button
3) Checking the information in the shopping cart
4) Clicking the "Checkout" button
5) Review and/or correct the entered data.
6) Binding submission of the order by clicking the "order subject to payment" or "buy" button
Before submitting the order, the customer can review their information and correct any errors by clicking the "Back" button in their web browser. Alternatively, they can cancel the order process by closing the browser. We will immediately confirm receipt of the order with an automatically generated email ("Order Confirmation"). This email constitutes our acceptance of your offer.
(5) Storage of the contract text for orders placed via our online shop: We will send you the order details and a link to our Terms and Conditions by email. You can also view the Terms and Conditions at any time at https://elja.at/allgemeine-geschaeftsbedingungen. For security reasons, your order details are no longer accessible via the internet.
§3 Prices, shipping costs, payment, due date
(1) The prices quoted include statutory VAT and other price components. VAT is shown separately on the invoices. Shipping costs, if any, will be added.
(2) Consumers have the option of paying by direct debit, PayPal, or credit card (Visa). Institutions can pay by invoice.
(3) Depending on the payment method chosen, additional costs may apply, which are clearly indicated in the online shop before the customer submits the order.
(4) In the event of late payment, statutory default interest for consumers of 4% shall apply.
§4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate shipment. Delivery will take place within 14 working days at the latest. The delivery period begins, in the case of payment in advance, on the day after the payment order is issued to the bank responsible for the transfer, and in the case of all other payment methods, on the day after the contract is concluded. If the last day of the delivery period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next working day.
(2) The following costs for postage and packaging will be incurred upon delivery:

(3) In the case of a sale involving dispatch, within the meaning of the Consumer Protection Act (KSchG), the risk of accidental loss or accidental deterioration of the goods sold shall only pass to the buyer upon delivery of the goods to the buyer.
(4) In the case of cross-border deliveries, the customer may be required to pay additional charges (e.g., customs duties). The customer is responsible for complying with any applicable customs regulations, import regulations, and the laws of the respective country when delivering goods abroad.
(5) Deliveries are made by post or a comparable delivery service. The seller endeavors to meet the announced delivery dates whenever possible. However, delivery dates, even if confirmed, are not guaranteed.

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity:

Customers who are consumers within the meaning of Section 1 Paragraph 2 of the Austrian Consumer Protection Act (KSchG) have the right to withdraw from this contract within 14 days without giving any reason. The seller expressly refers in these Terms and Conditions to the information on the right of withdrawal, which can be accessed via the internet platform at www.elja.at. This information is also included in the order confirmation email as per point 2.4.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but this is not obligatory.
Consequences of revocation
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.
We may refuse to issue a refund until we have received the returned goods and checked that they are in proper condition.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
The right of withdrawal does not apply to the following contracts:
Contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery, and in the case of custom-made products.

(6) If the customer has indicated during the ordering process that they will collect the goods from the seller, the customer will be notified by email as soon as the goods are ready for collection. The collection times can be found on the seller's website.
§5 Retention of Title
We retain ownership of the goods until the purchase price has been paid in full.
§6 Compensation for Damages and Warranty
Liability for damages caused by slight negligence is excluded. This limitation of liability does not apply to personal injury, assumed guarantees, or liability under the Product Liability Act. Warranty claims are governed by statutory provisions.
§7 Data Protection

§8 Final Provisions
The headings in these terms and conditions are for convenience only and do not restrict or otherwise alter the contractual provisions.
The place of performance for all services under this contract is 3451 Streithofen, Lower Austria.
Austrian law applies exclusively, excluding international conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The contract language is German. In the case of cross-border contracts concluded within the EU, those provisions for consumer protection that are mandatory under the law of the state in which the consumer has their habitual residence also remain applicable.
Should individual provisions of these terms and conditions be or become wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions.
